1. Application of Terms of Service

1.1. The terms and conditions below (hereinafter referred to as "Terms") are applied to the use of the Coinmotion.com website and service (hereinafter referred to as "Service"). The Service operated by ONEPAY PACIFIC LIMITED-a legal entity established under the Law of HongKong with registered address at :Unit 25A, 25/Floor, Wing Hing Commercial Building, 139 Wing Lok Street, Sheung Wan, HongKong, Registration Number: 2307417 (hereinafter referred to as "Service Provider") allow registered users to store, transfer and buy and sell Bitcoin

1.2. The use of the Service requires registration. By registering or otherwise using the Service the user (hereinafter referred to as "User") assures that he/she has read the Terms and agrees to accept and comply with these Terms.

2. Right of Use and User Information

2.1. The User receives the right to use ("Right of Use") the Service according to these Terms and other information and instructions concerning the Service. The User guarantees that the information he/she provides during registration ("User Information") to be correct.

2.2. The Service Provider reserves the right not to grant Right of Use when the User Information provided is inadequate, inappropriate or otherwise erroneous or when the User does not fill the prerequisites for granting Right of Use.

3. User Rights and Responsibilities

3.1. The User's account and password are personal and are not to be handed over or otherwise be made known to a third party. The User is responsible for all usage with their account. The User is to inform the Service Provider without delay if their account information's confidentiality is compromised.

3.2. The User is responsible for all direct and indirect costs induced by the use of the Service.

3.3. The User agrees to fully comply with these Terms, other guidelines and instructions concerning the Service, and in accordance to the law and good practice. The User agrees to refrain from actions which constitute as money laundering, can be viewed as or are comparable with money laundering or contribute to money laundering. The User agrees to comply with all instructions and rules presented within the Service.

3.4. The User acknowledges that he or she must provide identification deemed sufficient by the Service Provider in order to transfer bitcoins or money out of the Service.

3.5. The User commits not to send, receive or record in the Service or through the Service any material that does not comply with law or good practice and to not incite other users to do so.

3.6. The User receives and uses the Service at their own risk and is responsible for the acquisition, functionality and appropriate protection of any equipment, connections and software necessary to use the Service.

3.7. The user commits not to use malware, other techniques or other actions, which may harm the Service or the Service Provider's best interests or property.

3.8. The User liable for compensation to the Service Provider and directly to other parties in the event of incorrect usage, misdeneamors, unlawful or actions otherwise contrary to the Terms.

4. Service Provider Rights and Responsibilities

4.1. The Service is in principle available 24 hours a day. The Service Provider reserves the right to take down the Service or any part of it due to maintenance, installation, modification, public order or safety, excessive load on the system or other such reason.

4.2. The Service Provider reserves the right to add, modify or remove parts of the Service and to make free of charge sections of the Service subject to a charge or shut down the Service partially or fully. The Service Provider intends, when it reasonably possible, to notify about changes in the Service which may concern Users or cause an interruption to the Service prior to the change/interruption via the Service or by other means.

4.3. The Service Provider does not give any direct or indirect guarantees concerning the Service's operation or features and does not guarantee that the Service operates without interruptions or errors.

4.4. The Service Provider is not liable for any damages or other inconvenience or harm that erroneous or inadequate User Information may cause to the User or a third party.

4.5. The Service Provider is under no circumstances liable to compensate for any direct or indirect damages which are related in any way to the Service, the use of the Service or information or notifications that are available through the Service. Additionally, the Service Provider is not responsible for any damage that use of the Service, malfunctions in the Service, technical faults, malicious software, links or interruptions may cause to the User or third parties.

4.6. The Service is copyright protected by Finnish legislation. The Service may include material protected by copyright, trademark or other intellectual property laws. The User does not have, without the written consent by the Service Provider or other proprietor, to distribute, publish, copy, make available to the public or otherwise commercially take advantage of material contained within the Service, unless compelled by applicable law. The User does not have the right to form a new service based on the Service or any part of it.

4.7. Rights to material protected by copyright, trademark, or other intellectual property laws contained within the Service are held by the Service Provider or its contractual partners. Rights to material delivered by the User are retained by the User provided that the material may be protected by applicable laws.

4.8. The Service Provider has the right to remove the User and prevent their access to the Service if the User acts in violation of these Terms, other rules concerning the Service, law or good practice.

5. Processing of Personal Data

5.1. The Service Provider processes personal data supplied by the User in accordance to the Privacy Policy and Privacy Statement and applicable laws. The User gives the Service Provider unequivocal consent to process information mentioned in the Privacy Policy.

5.2. The Service Provider processes personal data in accordance to applicable laws and acting as the registrar.

6. Cookies

6.1. Cookies are used within the Service as described in the Privacy Statement.

7. Modification of Terms

7.1. The Service Provider has the right to one-sidedly change the Terms by notifying the User via email or within the Service. Changes take effect fourteen (14) days after notifying the User. The User accepts the Terms by using the Service.

7.2. After receiving notification of modification of Terms, the User may terminate the agreement prior to the changes taking effect.

8. Duration of the Contract

8.1. The contract becomes effective when the User uses the Service and/or when the Service Provider grants the User Right to Use the Service. No part of this contract will come to effect if the User is not granted Right to Use by the Service Provider.

8.2. The contract is effective for an indefinite period of time. Both parties may terminate the contract at any time without notice by email or within the Service without justification.

8.3. Both parties are relieved of obligations created by the contract for the time and to the extent that the failure to meet the Terms is caused by force majeure. An unusual event happening after filling and creating the contract, which is relevant to the contract, independent of the parties and whose effects can not be prevented or overcome with reasonable effort, is viewed as a reason for relieve from obligations. Such reasons may include war, rebellion, requisition, confiscation, interruption of energy supply, industrial dispute, fire, storms or other natural phenomena or other reasons with an equivalent effect that are independent of the User and Service Provider.

9. Transfer of Contract

9.1. The Service Provider has the right to transfer the Service, its hosting and all related customer relationships to another company.

9.2. The User does not have to right to transfer their rights and obligations as dictated by this contract to a third party. The User acknowledges in particular that their Right of Use is personal and may not be handed over to a third party.
